Privacy Policy

This Privacy Policy explains how HiMedia BV, a company incorporated under the laws of the Netherlands, with its registered office at Tijnmuiden 59, 1046 AK Amsterdam, the Netherlands, registered with the Dutch Chamber of Commerce (KvK) under number 76941566, trading as “Motiv” (“Motiv”, “we”, “us”), processes personal data for which it is the controller.

1. Scope and Our Role

This Policy covers personal data for which Motiv is the controller: personal data about our customers and their users, prospects, visitors to our website, and people who contact us.

When Motiv processes personal data on behalf of its business customers as part of providing the Service, such as the conversion and visitor data those customers track, Motiv acts as a processor. That processing is governed by our Data Processing Agreement and not by this Policy.

2. Personal Data We Collect

  • Account and contact data: name, business email address, company, role, account credentials (passwords are stored in hashed form through our authentication provider) and account settings.
  • Billing data: billing contact and company details, VAT number, and payment information processed by our payment provider. We do not store full payment card numbers.
  • Communications and support: messages, support requests and correspondence with us.
  • Website and usage data: pages visited, device and browser information, IP address and cookies on our website, and your use of the Service such as logins and actions, for security and improvement.
  • Prospect data: information you provide when you request a demo or contact our sales team.

3. How We Use Personal Data and Legal Bases

  • To provide and operate the Service and manage your account: performance of a contract.
  • To bill and collect payment: performance of a contract and compliance with legal (accounting) obligations.
  • To provide support and communicate with you about the Service: performance of a contract and our legitimate interest.
  • To secure the Service, prevent fraud and abuse, and maintain integrity: our legitimate interest.
  • To improve and develop the Service: our legitimate interest.
  • To market our own products and services to business contacts and prospects: our legitimate interest and, where required, your consent. You can opt out of marketing at any time.
  • To comply with legal obligations and to establish, exercise or defend legal claims: compliance with a legal obligation and our legitimate interest.

4. Cookies

Our website uses cookies. For details, see our Cookie Policy. Cookies and similar technology placed on our customers’ own websites as part of the Service are governed by the Data Processing Agreement, not by this Policy.

5. How We Share Personal Data

We share personal data with service providers who process it on our behalf under contract:

  • Hetzner Online GmbH (EU): hosting and infrastructure.
  • Stripe: payment processing.
  • Resend: transactional email delivery.
  • Cloudflare, Inc.: DNS, content delivery and security.
  • Cookiebot (Usercentrics A/S, EU): cookie consent management and consent logging on our website.

We may also share personal data with our professional advisers, and with authorities or in connection with a corporate transaction, where required or permitted by law. We do not sell personal data. An up-to-date list of our sub-processors is available at getmotiv.io/legal/sub-processors.

6. International Transfers

We store personal data within the European Union where possible. Where a provider processes personal data outside the European Economic Area, such as Cloudflare, Stripe or Resend in the United States, we rely on an adequacy decision of the European Commission (the EU-US Data Privacy Framework) and/or the EU Standard Contractual Clauses.

7. Retention

We retain account and related personal data for as long as your account is active and thereafter for as long as reasonably necessary for the purposes described in this Policy. Billing and accounting records are retained for the statutory period, which in the Netherlands is seven (7) years. Website and usage data is retained for a limited period. When personal data is no longer needed, we delete or anonymise it.

8. Your Rights

Under the GDPR, you have the right to access, rectify, erase, restrict and port your personal data, to object to processing based on legitimate interest, and to withdraw consent where processing is based on consent. To exercise these rights, contact info@getmotiv.io. You also have the right to lodge a complaint with the Dutch Data Protection Authority (Autoriteit Persoonsgegevens).

9. Security

We apply appropriate technical and organisational measures to protect personal data, including encryption in transit and at rest, access controls, and storage within the European Union.

10. Children

The Service is intended for businesses and is not directed to children. We do not knowingly collect personal data from children.

11. Changes to This Policy

We may update this Policy from time to time. We will notify you of material changes. The current version is available at getmotiv.io/legal/privacy.
